Official Federal Decree in Mexico to Suspend Activities of Vulnerable Workers and Persons

On Wednesday March 24th, 2020, Mexico’s President Lopez Obrador announced a federal decree to protect the most vulnerable by keeping them home from work and to avoid attendance in workplaces, public spaces and other crowded places.

We advise businesses and manufacturers to prepare for this.

  • Adults over 65 years old;
  • People at risk of developing serious illness and/or dying from it;
  • Pregnant and nursing women;
  • Children under 5 years of age;
  • Persons with disabilities;
  • Persons with chronic non-communicable diseases;
  • People with a disease or pharmacological treatment that suppresses their immune system.

In addition, the decree mandates:

  • Temporarily suspend school activities at all levels until April 17, 2020, as established by the Ministry of Public Education;
  • Temporarily suspend the activities of the public, social and private sectors that involve the physical concentration, transit or displacement of persons from the entry into force of this Agreement until 19 April 2020.

In accordance with the published decree, from this moment onwards the obligation to provide services/work is suspended, and in terms of the provisions of the Federal Labor Law, we consider that pregnant and breastfeeding women must receive their full salary, while the rest of the workers who are in the conditions described above will be subject to the provisions of article 429, section IV of the Federal Labor Law, i.e. a minimum daily salary in force until 19 April 2020.
